“Police Officer’s Promotion Suit Thrown Out by High Court”

The High Court in Kumasi has dismissed a lawsuit filed by Chief Inspector Samuel Krah against the Inspector-General of Police and the State, seeking promotion to the rank of Assistant Superintendent of Police (ASP).

In a judgment delivered on Friday, June 14, 2024, Justice Kwasi Anokyi Gyimah held that attaining higher academic qualifications does not entitle Chief Inspector Krah to automatic promotion. The court stated that the plaintiff failed to prove his claim and that entry into the Police Academy is through competitive examination or special recommendation, as per Police Service Regulations.

The court further noted that the Police Administration’s promotion processes are based on merit, seniority, and availability of vacancies, and that Chief Inspector Krah’s academic achievements, though commendable, do not supersede these criteria. The court also emphasized that the Police Service has a clear policy of promoting officers based on their performance, conduct, and dedication to service, rather than solely on academic qualifications.

The plaintiff had argued that despite his 25-30 years of service, the Police Administration had promoted his junior colleagues under a special amnesty program but denied him the same opportunity. However, the court found that these promotions were based on specific circumstances and not solely on academic qualifications.

The court’s decision sets a precedent for police promotions, emphasizing merit and competitive examinations over academic qualifications alone. This ruling may have implications for future promotion disputes within the police service.

Chief Inspector Krah’s legal team has expressed disappointment with the ruling and is considering an appeal. The Police Administration has welcomed the court’s decision, stating that it vindicates their promotion processes and ensures that promotions are based on merit and dedication to service.
