Lawsuit Filed Against GRA and Finance Ministry Over Tax Waivers

Three Minority Members of Parliament, led by Deputy Leader Emmanuel Armah-Kofi Buah, have initiated a lawsuit against the Ghana Revenue Authority (GRA) and the Finance Ministry. The lawsuit challenges the planned tax waivers for 42 companies under the 1 District 1 Factory Initiative.

The MPs, including Bernard Ahiafor (Akatsi South), Kwame Agbodza (Adaklu), and Emmanuel Armah-Kofi Buah (Ellembelle), argue that the tax waivers are not in Ghana’s best interest and violate Article 174 of the 1992 Constitution.

They are seeking a Supreme Court declaration that the waivers are unconstitutional, null, and void.

The plaintiffs assert that the GRA’s decision to grant tax waivers is inconsistent with the Constitution and harms the country. They urge the Supreme Court to intervene, citing the court’s exclusive jurisdiction to interpret the Constitution.

Bernard Ahiafor emphasized the need for the Supreme Court’s intervention, stating, “Any citizen who believes a constitutional provision is being contravened can seek interpretation and declaration from the Supreme Court, the apex court.”

The lawsuit seeks to suspend the tax waivers and ensure that the GRA and Finance Ministry act in accordance with the Constitution.
